🎯 the basics

  • Who we are: Entrinsia Inc., a Delaware corporation with offices in California
  • What this is: An agreement between you and us for using the MementoBook app
  • Age requirement: You must be 18+ to create an account
  • Your first event is free - no credit card needed

✓ what you can do

  • Use MementoBook for personal events or internal business purposes
  • Create events and collect messages from guests
  • Set up kiosks at your events for guest messages
  • Own and control all your event content and guest messages
  • Export your data anytime
  • Delete your account whenever you want
  • Purchase event credits that last 1 year
  • Get automatic video compilations of your event messages

✗ what you can't do

  • Copy, modify, or reverse engineer the app
  • Use it for anything illegal or harmful
  • Build a competing product using our service
  • Upload content that infringes others' rights
  • Create fake, deceptive, or malicious events
  • Harass, abuse, or spam anyone
  • Share or resell your account or event credits
  • Try to hack or bypass our security

💰 pricing & event credits

  • First event: Completely free, no credit card required
  • Event credits: Buy individual event credits as needed
  • Credits expire: 1 year from purchase date
  • No refunds: Event credits are generally non-refundable (but contact us if there's a technical issue)
  • Subscriptions: If we offer subscription plans, they auto-renew unless you cancel
  • You'll get reminders: We'll email you 30 days before credits expire

🔒 privacy & your data

  • You own your content: All event data and guest messages belong to you
  • We process it: We store and process your data to provide the service (video compilation, storage, etc.)
  • Where it's stored: U.S. cloud servers (AWS, Google Cloud, etc.)
  • Security: We use encryption and standard security practices, but nothing is 100% secure
  • You're responsible for: Getting proper consent from guests when collecting their data
  • Privacy laws: You must comply with GDPR, CCPA, and other privacy laws
  • Export anytime: Download all your data whenever you want
  • Delete anytime: Request deletion through settings or email support@entrinsia.com

⚠️ important responsibilities

  • Get consent: Make sure guests know they're being recorded (video/audio messages)
  • No minors without permission: Get parental consent if collecting data from anyone under 18
  • Secure your kiosk: You're responsible for physically securing tablets and devices
  • Recording laws: Follow your local laws about recording consent (some states require all-party consent)
  • Guest privacy: You're the "data controller" for guest information - you must handle it legally
  • Post notices: Let guests know they're being recorded at your kiosk
  • Keep backups: We're not responsible if data is lost - maintain your own backups

🎬 video compilation

  • We automatically compile guest messages into one video
  • Processing usually takes minutes to hours after your event
  • Videos are stored based on your plan or event credit terms
  • You own the compiled video
  • We don't guarantee perfect quality - processing may have minor issues
  • Download your video before storage period expires

disclaimers

  • Service is "as-is": We don't guarantee it'll be perfect, uninterrupted, or error-free
  • Use at your own risk: We're not liable for lost data, device damage, or event issues
  • No professional advice: This isn't legal, tax, or professional advice

liability limits

  • Maximum we'll pay: The greater of what you paid us in the last 12 months or $100
  • No indirect damages: We're not liable for lost profits, data, or business interruption
  • This is a fundamental term: We couldn't offer the service at this price without these limits

you'll defend us if

  • Your content or events violate someone's rights
  • You break laws (especially privacy or recording laws)
  • Guests at your event cause problems
  • You didn't get proper consent from guests or minors

disputes & arbitration

  • Try to resolve informally first: Email support@entrinsia.com
  • Arbitration required: Most disputes go to binding arbitration, not court
  • No class actions: You agree to resolve disputes individually, not as a class
  • Delaware or California law applies
  • You have 1 year: Claims must be filed within 1 year or they're barred
  • You can opt out: Email within 30 days to opt out of arbitration

🚫 we can terminate if

  • You violate this agreement
  • You engage in illegal or harmful behavior
  • You don't pay for services
  • Your account is inactive for 2+ years
  • We're legally required to
  • We discontinue the service

If we terminate: You have 30 days to export your data, then we may delete it.

📋 key policies to know

  • DMCA compliance: We respond to copyright infringement notices
  • No biometric identification: We don't do facial recognition or biometric analysis
  • Service changes: We can modify features, pricing, or the app with notice
  • No guarantees: We can't promise 100% uptime or data preservation
  • Export restrictions: Can't use in embargoed countries
  • Third-party services: We use Stripe, AWS, etc. - they have their own terms
